These Terms of Service ("Terms") govern your use of circlebusinessfunding.com and all services offered by Circle Business Funding, a ("Circle," "we," "us"). By accessing the site or submitting any application, you agree to these Terms. If you do not agree, do not use the site.
You may use this site and apply for financing only if you are at least 18 years of age, are authorized to bind a U.S.-based business, and the information you provide is accurate and complete to the best of your knowledge. We may decline to do business with any applicant for any lawful reason.
Submitting an application does not constitute an offer of credit. All applications are subject to underwriting review. Approval, terms, and pricing are determined at our sole discretion based on our credit policy and applicable law. We may obtain consumer and commercial credit reports as part of underwriting.
By submitting an application, you (a) certify that all information provided is true, complete, and not misleading, (b) authorize Circle and its agents to verify any information provided and to obtain consumer and commercial credit reports on the applicant business and any owner of 20%+ of the applicant business, (c) authorize Circle to contact you by phone, email, and SMS, and (d) understand that we may report payment performance to commercial credit bureaus.
Loans, advances, and credit products offered by Circle are originated and serviced by Circle Business Funding or its FDIC-insured originating bank partners as applicable. SBA loan products are offered through SBA-approved Preferred Lenders. The specific terms of any approved financing are governed by the executed loan or financing agreement, not by these Terms or any pre-application communications.
All content on this site, including the Circle name, logo, graphics, text, and design, is the property of or its licensors and is protected by U.S. and international copyright and trademark laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
The site and its contents are provided "as is" without warranty of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, Circle, its parent, affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the site or services. Our total liability for any claim arising out of these Terms shall not exceed $1,000.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any disputes shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction in those courts.
We may modify these Terms at any time by posting an updated version. Your continued use of the site after changes are posted constitutes acceptance.
